The LAPD is inside Rockingham
Opportunity to plant glove begins. |
0555 | Phillips tells Arnelle Nicole was murdered she breaks down. {Det. Lange is inside} Kaelin hears her scream out in shock. |
0556 | Arnelle & Det Lange return to kitchen, she calls Cathy Randa. Crying, Arnelle gives phone to Lange, who talks with Randa. |
0558 | [phone bill] Arnelle determines OJ's location, tells Lange & Phillips. |
0600 [6:00 AM] |
0600 | Cathy Randa may have contacted Simpson in Chicago. Arnelle is upset, crying & distraught. |
0605 | Police call Simpson in Chicago. Vannatter told where he is. ***** Simpson learns Nicole is dead ****** CLARK: AND THEN YOU SPOKE TO SOMEONE WHO ACKNOWLEDGED THAT HE WAS MR. SIMPSON? PHILLIPS: YES. CLARK: WHAT HAPPENED NEXT? PHILLIPS: I TOLD HIM WHO I WAS, I WAS DETECTIVE RON PHILLIPS FROM THE LOS ANGELES POLICE DEPARTMENT AND THAT I HAD SOME BAD NEWS FOR HIM AND HE SAID SOMETHING ABOUT, "WHAT'S THAT?" AND I SAYS, "WELL, I GOT SOME BAD NEWS. YOUR EX-WIFE, NICOLE SIMPSON, HAS BEEN KILLED."*???* Did Lange also tell him Nicole was murdered *???* |
0607 | Arnelle speaks to her father. said: "Dad, Nicole is dead. She is not here with us any more." |
0609 | Vannatter confirmed Simpson in Chicago "SHORTLY AFTER SIX O'CLOCK THAT MORNING". They give Simpson a police cell phone number.****? Simpson breaks glass, cut hand ?***** |
When he applies for a SEARCH WARRANT, Vannatter will lie under oath -- asserting that Simpson's trip was "UNEXPECTED", dispite fact he had opportunity to confirm Arnelle's statement about it being a planned business trip. Vannatter will also withhold from the court information associated with Simpson's immediate return upon notification of Nicole's death. In his book, and media appearances, Vannatter represents he did these things with the express approval of Marcia Clark. In her book, Clark repeatedly expresses concern over his failure to seek her approval at critical times. As a result, two key players in our saga sharing responsibility for improper, possibly illegal, actions. |
|
0610 | [phone bill - 1st call]{5 min} OJ Simpson calls house from Chicago. |
0610 | [Exibit 72] Simpson calls friend & attorney, Skip Taft. "anxious" Simpson calls Merrill three times. Calls Louis Brown, gets Denise who "hysterically" screams at him, {possibly saying "You killed her"} and hangs up on him. |
0612 | Arnelle asked Lange if Juditha Brown had been notified she hadn't. {What is Vannatter doing?} |
0612 | Fuhrman "finds" Right Hand Glove. |
0615 | [phone bill] Arnelle calls Juditha Brown, said, "Judy, I have some really bad news for you" and, umm, I attempted to tell her and I started crying and I gave the phone over to Lange. **** Vannatter and Fuhrman aren't there. ***** |
Opportunity to plant glove ends. |
0616 | Lange tells Arnelle to pickup Sidney & Justin at police station.**** TV Room: Arnelle still in pajamas, answers phone ***** |
0617 | [phone bill -- 2nd call] Simpson calls Arnelle -- He was very upset. He was crying. He was saying, "Arnelle, I don't understand." {5-10 min}**** Arnelle tells father all she was told by police **** **** Now, Simpson definately knows Nicole was murdered ****[Sequence Fuhrman showed: 1- Phillips, 2- Vannatter, 3-Lange] 06 FUHRMAN: The same route that I took originally from the 07 front entrance: directly south in front of the garage and 08 then entering the path going eastbound, continuing down, 09 explaining the areas and how and why I determined that the 10 main house was separated by this corridor from the 11 bungalows and how the architecture changed, how -- I was 12 describing that to them -- And then how I looked down and 13 saw the dark object 15, 20 feet from me and, as I got 14 closer, I realized what it was and it was right almost 15 exactly where Mr. Kaelin described a crashing noise. |
Fuhrman states: "almost exactly where Mr. Kaelin described a crashing noise." This locks glove to noise, and to time of noise. |
0618 | Vannatter sees Right Glove for first time. {6:15 - 6:30} After glove Vannatter asks Kaelin for key to Bronco. |
0621 | [phone record] Vannatter calls Brown family to inform them of Nicole's death. Denise Brown, sister of victim Nicole Brown, screams to detective Vannatter, "I knew he'd do it! I knew that motherfucker would kill her! I knew it! I knew it! O.J. did it! O.J. killed her! I knew that son of a bitch was going to do it!" When the victim's father, Lou Brown, takes the phone, Vannatter can hear Dinese -- and apparently her mother, Juditha -- in the background. They are wailing, and shouting, "O.J. did it!" |
Thus we have a hysterical Denise Brown establishing the stage for general acceptance of the glove/noise relationship which is about to be introduced by Detective Fuhrman. It is the hysterical acqusation by Denise Brown which sets the stage for -- what Johnny Cochran would later address as -- "The Rush to Judgement". |
|
0623 | Simpson -- distraught -- told Arnelle he'd come right home. |
Speaking at The Washington Press Club, 15 May 1997, Marcia Clark states of the glove: "I really don't know that it did shrink due to blood stains." |
Appearing on Larry King Live, 24 february 1997, Mark Fuhrman stated I didn't see when it actually happened. I saw it in the news. That was pretty easy. It was repeated dozens of times. I just couldn't believe they actually took the original glove and did a demonstration that they didn't know how it would come on, especially on O.J. Simpson.... It didn't fit. But there was some incredibly bad acting going on in that room too. |
|
0625 | after seeing glove, Lange checks doors on pathway. {Mar 8th: Rockingham glove has caucasian hairs on it.} |
0630 [6:30 AM] |
Daniel Petrocelli Opening "Argument"
Simpson "is awoken at about 8:30 Chicago time, 6:30 our time, and he's told that his former wife is dead; she's been killed. And he is absolutely distraught. The police won't tell him how; they won't tell him what happened. He asks about his kids. They've been taken to the police station. He is exceedingly upset. He's distraught. He doesn't know what to do." "He calls Cathy Randa, his assistant. He calls Leroy Taft. Leroy Taft is his manager, his friend, his lawyer. And he says, I have got to get back to LA. I've got to bet back to LA. And he's making calls an he's rushing, between trying to pack his toiletries, and he's rushing between the phone, which is by his bed, and the bathroom, and he cuts -- Breaks a glass. You'll see pictures of it there. The Chicago police went in afterwards, took pictures of it. You'll see the bloody towel. And he is rushing back and forth, and he cuts his hand on the middle finger of his left hand with the glass.
And he is frantic. He calls Jim Merrill, the guy who picked him up the night before. He doesn't know if Jim Merrill lives five minutes or 45 minutes or 55 minutes from the airport, but he does know -- because he called downstairs, contrary to what Mr. Petrocelli says -- he does know there are no cabs. He then is frantic, calls him back for the car. You've got to get here. I've got to get back to Los Angeles. Within 65 minutes of being told that his wife, former wife has been killed, the mother of his children, he's on an airplane back to Los Angeles. He goes down into the lobby area of the hotel, and in the lobby area of the hotel, he asks the clerk for a band-aid because he cut his finger. She sees it at that time, not the night before, not a few hours before, and he gets on the airplane." |
|
0630 | [phone bill] Arnelle makes FOUR phone calls. {10-15 minutes} I called Al Cowlings, my mother, my brother and a friend. Monday, Arnelle calls Jason ignors it and lets machine answer. msg "Jason, call me back." Arnelle calls her mother, she hasn't reached Jason. Jason's mom calls him -- She said, "Call your sister. It's important."Arnelle's call to AC gets him rushing to Rockingham.
Jason calls his sister, [06:30-07:00] Arnelle tells him, "Jason, you need to come to dad's house." She said, "Jason, Nicole had -- Nicole had just died."Jason thinks Nicole died of steroids, Arnelle tells him she was killed.Jason rushes over to Rockingham. The excitement triggers an epilepsy related difficulty breathing, he stops at his girlfriend's house for about five minutes then continues to Rockingham. |
According to Marcia Clark, at about 6:30, Arnelle is with Officer Vasquez at the West L.A. station, where Sydney and Justin are being held. For that to be accurate, Al Cowlings -- who drove Arnelle there -- must also be at West L.A. station. |
|
0630 | Simpson uses cellphone to make calls from Hotel Lobby. Simpson has cut on finger wrapped in toilet paper asks desk clerk for Band-Aid. [hotel records] Simpson checks out of Hotel and heads for airport. Calls Merrill {Hertz}, he's leaving Chicago. Asks him to take him to airport; but then grabs ride with Hertz people. He calls Cathy Randa again, gives her data on return flight. Calls Skip Taft, tells him That Nicole had been killed. calls Skip's office, then Skip again. Then call's Kaelin's number. Cellphone & Airfone records indicate 3-4 attempts to reach Kaelin. [approx. 7:40] Calls Jonah Wilson on Airfone {Arnelle's friend} twice, total 10 minutes. multiple calls on Airfone. Attorney in next seat on plane overhears about police suggests OJS have lawyer with him. |
0635 | At Bundy, {? at daylight} Riske sees Photographer Rokahr out front. At Rockingham, All the Detectives are gone from Kitchen area and Fuhrman is again talking to Kaelin |
0645 | {?} Merrill gets to hotel, Simpson is gone; he then goes to airport & checks the clubs on flight to LAX.14 Clark: If you know, sir, what time was it when you 15 made the observation of those blood droplets in the 16 driveway after you'd just seen the glove? 17 Vannatter: I -- again, I would have to estimate that. I 18 believe it was around 6:45 or so in the morning. |
0645 | A.C. arrives at Rockingham to help Arnelle get Sidney & Justin. Lange comes in and talks to A.C. Cowlings. |
0645 | Fung meets Mazzola at SID Labratory. One hour forty-five minutes have lapsed since Mazzola was called. |
0649 | [per civil trial] The coroner's office calls to send a coroner down to pick up the victim's bodies, called at 6:49. They are told to hold off. The lead detectives have decided to ignor the muder scene in favor of Rockingham.
|
Stupid Question Time Petrocelli asked Simpson:Why were you so insistent on finding out from Kato Kaelin what was going on?Arnelle was hysterical, Denise Brown was hystrical and publically accusing Simpson of killing Nicole -- she was also stopping him from reaching Louis Brown -- only Kaelin was on the scene and in communication with the police. Who else would he call to find out what was happening; where the children were; etc? | |
0650 | Ofc. Riske sees Detectives Phillips & Fuhrman return and Second Fuhrman photo. |
During the Criminal Trial, Cochran failed to produce the sequence number associated with the 7:00 photograph -- nor was it produced by Baker during the Civil Trial. Rokahr is reported to have intended to recant his prior testimony, with regard to Fuhrman being initially photographed prior to 5:00 AM -- becaused of timing factors, this was ruled inadmissible at the Civil Trial. Fuhrman, at Bundy on orders from Vannatter, Establishes Photographic Alibi -- ONLY IF photos 33 & 34 were taken prior to 5:00 AM. Sequence numbers, and photographic content, would establish the factual of the charge that Fuhrman was in the crime area prior to 5:00 AM. |
|
0700 [7:00 AM] |
0700 | Simpson leaves Chicago 9:00 AM CST, arrives in Los Angeles 11:30 AM PCT Fuhrman's estimate [7:00-7:15] as to when he returned to Bundy. Fuhrman has photo {People's-55} taken of him lifting bush. People's 59 verses people's 55, ?was Goldman's foot moved to get 2nd glove? [0700-0715] Arnelle and Cowlings go to get Sidney & Justin. {15-20 minutes after he arrives} |
0710 | Criminalist Fung arrives at Rockingham. {per his notes} Mazzola "Officer-in-charge"23 Vannatter: ... In fact, I believe the criminalist arrived 24 there shortly after 7:00 o'clock, and I showed him the 25 physical evidence outside and left him instructions that 26 it was to be protected, marked and photographed. And 27 that the fact that there was a dog running loose on the 28 compound, so to be very careful to protect the evidence.***** Lead Detective Doesn't Take Notes ***** |
0715 | Police and Kaelin are only ones at 360 north Rockingham. Fung calls SID, speaks to Lisa Sibetta, seeking supervisor. Fung is informed that the Bronco is part of crime scene. He is also informed by Vannatter there is another crime scene at Bundy.Riske is relieved from the crime scene duty at Bundy. [0700-0715] Fuhrman, Rokahr & Roberts return to Rockingham. |
Burden of Proof, 19 May 1997
FUHRMAN: ... Brad Roberts found as much crucial evidence that morning as I did, ... What's interesting is -- remember the issue when I returned to Bundy to look at the other glove and, supposedly, that picture was taken at 5:00 in the morning or 4:00 in the morning? Well, Brad Roberts returned to Rockingham with me right after I looked at that glove. He could have corroborated that. |
Here Fuhrman misrepresents the glove-photo discussion. The 7:00 photograph -- in which Fuhrman lifts the bush to show there is no second glove -- has never been in question; Officer Riske testified to witnessing it. It was the two photos of Fuhrman pointing to the single glove which ROKAHR testified he shot prior to 5:00 AM -- these are the incriminating photos. It should also be noted that nobody testified to Roberts being present at either time. |
FUHRMAN: Yet Brad Roberts -- when we returned to Rockingham, I explained to Brad Roberts what was going on there with the Bronco and what I saw. I showed him the spot of blood, and I told him -- I said it was very difficult to look inside the Bronco because of the tinted-type windows. Now Brad on his own went to the passenger side and looked inside that Bronco and saw blood all over the inside. He called to me, and I looked at it, and Vannatter, 50 or 60 feet away, was standing by the corner, and I yelled to him. He came down. He looked in the Bronco, and he was very surprised, very excited about that discovery. He then went back to the house. |
Thus we learn that it was Brad Roberts, and not Fuhrman, who sees into the Bronco and discovers blood. We also learn the whereabouts of Detective Phillip Vannatter: he is outside Rockingham, at the corner of Ashford. NOTE: Vannatter went back into the house. But how? There is no mention of him using the Rockingham gate. In fact, Fuhrman will tell us the gate is closed when they discover the blood trail. |
FUHRMAN: |
It is Brad Roberts who discovers the blood trail leading to the Rockingham Front door. A trail of blood which argues that, upon arrival, the killer went directly into the house. |
|
0720 | Glove area is searched for blood, or other trace evidence -- none found. Fung walks south pathway. No supporting evidence found.
There is absolutely no trace evidence on the pathway where the glove was found. [0715-0730] Arnelle & Cowlings return with Sidney & Justin.
16 Clark: Did the children ever arrive at the residence? 17 Vannatter Yes. 18 Clark: Do you recall when? 19 Vannatter I believe it would have been prior to 7:30, 20 because that's when I asked for the place to be 21 secured. Totally secured. 22 Clark: When you say "totally secured," then what do 23 you mean by that? 24 Vannatter I asked Arnelle and a friend of her's, Al 25 Cowlings, that she had called to help her pick up the 26 children, if there was a place that they could go away 27 from the residence to eliminate any possible 28 contamination of any evidence that may be in the house, 0066 01 and they said yes. 02 And at that point I asked them if they would 03 mind doing that, and they said no. |
Burden of Proof, 26 May 1997
FUHRMAN: ... -- remember the issue when I returned to Bundy to look at the other glove and, supposedly, that picture was taken at 5:00 in the morning or 4:00 in the morning? Well, Brad Roberts returned to Rockingham with me right after I looked at that glove. He could have corroborated that. |
An interesting bit of misdirection associated with the 7:00-7:20 AM time period; the picture at issue was not the one witnessed by Riske, the one in which Fuhrman lifts the bush to establish there is no second glove there, it is the earlier photos -- #34 & #35. Thirty-four and thirty-five were the thirty-forth and thiry-fifth pictures taken that day. It was established in testimony, at least five other pictures were taken immediately thereafter -- none of them the bush picture. |
FUHRMAN: ... Brad Roberts -- when we returned to Rockingham, I explained to Brad Roberts what was going on there with the Bronco and what I saw. I showed him the spot of blood, and I told him -- I said it was very difficult to look inside the Bronco because of the tinted-type windows. Now Brad on his own went to the passenger side and looked inside that Bronco and saw blood all over the inside. He looked in the Bronco, and he was very surprised, very excited about that discovery. He then went back to the house. What's really interesting here -- Vannatter testifies that he made that discovery. He also says that he made the discovery of the drops of blood, yet he never brought that to anybody's attention. There's another interesting... |
|
|
0730 | Fuhrman spots blood in entryway while, near kitchen, AC Cowlings is talking to Vanntter. 14 Clark: Okay. To the best of your knowledge, sir, 15 when you secured the house -- when you made the 16 determination to secure the house, was A.C. Cowlings 17 already there or did he come up later? If you know. 18 Vannatter: He was there because I spoke with him.Arnelle is asked to leave Rockingham. |
Times are getting confused by testimony. Fung's Notes arrival near 7:00. At that time, Vannatter has him collect physical evidence. At 7:00, Fuhrman & Roberts should be at Bundy. So we have the question, what physical evidence has Vannatter instructed Fung to collect? |
Fuhrman {Burden of Proof}: In Vannatter's book, on page 33, he talks about when Brad and I arrive at Rockingham after I looked at the glove at Bundy. He says that he stands there with us and says, "Let me show you guys something," shows us all the drops of blood on the driveway, takes us to the Bronco, and shows us the blood inside. That never occurred, and in my polygraph that I took, I specifically asked a question to be asked, "Did Phil Vannatter show you any evidence in or on the Bronco?" My answer was no, and it was truthful. This is a problem. |
On page 33, Vannatter states: After being briefed by Vannatter, Roberts walks through the front door of the house and sees more drops of blood inside on the floor of the foyer. Roberts immediately tells Vannatter, who exclaims, "Jesus Christ, the blood goes right into the house." |
Fuhrman {Burden of Proof} on Roberts role: Did we keep a key prosecution witness -- and he was key, and let me tell you he did a great job. He found all those blood drops on the driveway, and he marked them all, and Dennis Fung took every fourth or fifth one. |
During the civil depositions, Al Cowlings also mentioned this discovery. When these drops were noticed, the police had been using the front door -- as their sole means of access to the house -- for over an hour. At the moment of discovery, Vannatter was near the kitchen, talking to Cowlings. Fuhrman tells us that it was Roberts who first marked the blood trail -- and that Fung removed the cards and replaced them with ones marking every third or forth droplet. The blood trail is import to understand the case. |
The one thing which all the officers agree upon: |
The blood trail is linear. It leads directly from the Bronco into the house, and directly from the house to the Bronco. At no time does it go anywhere near the south pathway -- making it impossible for the pathway to have been part of the journey beginning at one point, and ending at the other. Therefore, the evidence and assertions of ALL the detectives and the criminologist concur, whoever left the blood trail could NOT have detoured, and therefore could NOT have left evidence on the south pathway. |
Therefore, the Glove was Planted |
|
0735 | [per Civil Trial] OJ Simpson is on a plane returning to Los Angeles. |
0741 | Simpson is on plane heading back to Los Angeles. |
0800 | While clearing the house, Detectives Fuhrman & Roberts see socks on the carpet at the foot of Simpson's bed. |
