9:00 PM Everyone is on the phone.

Jennifer F. Ameli, a clinical psychologist, testified in a May 22nd Deposition, that she never told police or prosecutors about the conversation she had with Nicole the night of the murder. She didn't elaborate on her reasons for keeping her silence.
In her final telephone conversation with Ms. Simpson, Ameli testified she suggested to Ms. Simpson that she seek the companionship of a friend that night.
"I told her that maybe she should ask someone to come and stay with her if she was frightened that evening after all that had happened," referring to the confrontation.
Ameli said after the murders her office and home were burglarized. She also said she repeatedly received electronic pager messages that spelled the word, "death."

The psychologist counseled both Ms. Simpson and Goldman, including at least one group session, after meeting her through Goldman.
Nicole began seeing Ameli, in March 1994, claiming she had endured years of abuse at Simpson's hands. Ameli testified that in a June 1994 therapy session Nicole told her she was seeing Allen again.

Just weeks before she was slain, Nicole Simpson told her therapist she was "seeing" football star Marcus Allen "and that she and O.J. had fought about it."
According to Ameli, Ms. Simpson spoke openly of her romantic relationship with NFL running back Marcus Allen. Ameli said Simpson knew of this relationship, and also was aware that she was growing closer to Goldman; stating she believed the relationship with Goldman was not sexual.
Simpson has testified that he was aware of a short affair in 1993 between Nicole and the former Kansas City Chiefs running back. But he has denied any knowledge of whether they restarted their relationship.

"The relationship didn't happen," Marcus Allen said, according to transcripts of his deposition taken May 31 in Kansas City.
Allen said, Simpson asked him to testify in his criminal trial that Simpson had not grown angry when Ms. Simpson announced she had had an affair with Allen, he testified. Since he denied the romantic relationship had taken place, Allen said in the deposition, he could not testify in the criminal trial.

Rockingham LAPD detective Lange is making constant cellphone calls, each punctuating a development in the case.

There are several points that should be observed, failure to do so will result in a complete missing of the techniques applied bu counsel.

The primary accusitory element has two components:

  1. The defense is continually required to prove a negative -- to prove innocence.
  2. The evidence for guilt is linked to that which isn't seen.
  3. The prosecution attempted to hide witnesses by not calling them.
  4. When called, witnesses prosecutors sort to exclude were personally attacked, rather than impeached.
  5. The plaintiff used "parlimentary procedures" to exclude all exculpatory information from consideration by the jury.

In both a rational and legal sense, these elements go directly against the American concept of Justice. Yet, in this case, a significant portion of Americans have decided to set aside the very laws which are their pride and protection. Some defend this destruction of a legal system by asserting so reaction to a double homicide in Los Angeles. However that belittles the fact, there are -- on average -- two brutal murders a day in Los Angeles.

0530Paula Barbieri awakens as Orenthal James Simpson exits her bed. The previous night they had gone to a "charity" function -- returning to Paula's for a night of love making which Paula wished to continue; but OJ had a routine which he intended to maintain.
0600Simpson leaves apartment for his morning golf game. Angered by his leaving, and jealous of his love for golf, Paula decides she'll give him an ultimatum -- her or golf. She leaves the message on OJS's voice mail. Later -- after hearing Brian "Kato" Kaelin's testimony, Paula will save face by claiming her message ended their relationship.

Jason wants to confirm menu, so he calls Nicole. Nicole decides that the kids would be "antsy" and the expense too great to justify dinner there; instead she'll take them to Mezzaluna.

1430Jason Simpson leaves his apartment for work.
Earlier, Nicole had called to cancel arrangements initiated Friday, It was the chief's day off, Jason was chef from 3:00 PM to Closing {that night around 10:00-10:30}.
JASON: They wanted to go to dinner. I had to work, so what better idea, "Why don't you come to my resturant?"

Simpson, having played golf & cards earlier, is talking to Kato in kitchen nook area -- Five fours BEFORE he retrieves Paul's "breakup message" Simpson is telling Kato he had decided not to marry Paula. Kato askes if OJ would like to meet a Playboy model -- and runs out to buy the issue where she is pictured. He introduces OJ to her by phone -- the long distance charges confirm the call.

1500 [3:00 PM]
1500Jason Simpson begins work at Jackson's Resturant, located on Beverly, between Doheny & Robertson.

BRIAN GERARD KAELIN(KATO) introduces Simpson to Playboy Model -- a possible replacement for Paula. Introduction is done by long distance telephone.

After his Basketball game, Brian Kato Kaelin stops at VONS for food -- which he eats in his car; afterward, still hungry, he returns home.

What sinister implications can we derive from the fact Kaelin ate in his car?
Fifty percent of average daily revenues, for the typical MacDonald's, are derived from their Drive-Thru Window. The average celebrity avoids establishments which require them to stand-in-line. Phrased another way, celebrities avoid situations which invite unrestricted exposure to the general public.
For context: President William Clinto is reportedly adicted to McDonald's Cheeseburgers, but how often does he stand-in-line waiting to be served?
VON's has no drive-thru window, Kaelin was not a celebrity, nor did he have a limousine scheduled for arrival within the hour. However, Clark implied a sinister purpose to Simpson's use of the Drive-Thru, which she did not ascribe to Kaelin's activities.
Those who begin with an assumption of guilt retroactively impute sinister context to normal activities. Those who who expect accusations to be based in facts, tolerate no such "hindsight".
1830 [6:30 PM]
1830Sydney Simpson Dance Recital ends, Paul Revere High School.
1840Nicole & party of ten arrive at Mezzaluna Resturant. Nicole is wearing a Mid-thigh Black Halter Dress.
1845JOHN ANTHONY DE BELLO {General Manager} arrives at Mezzaluna; Nicole & party of ten are already there.
1850In his June 13th statement, Simpson tells the police he arrived home at "seven-something", changed cars and called Paula Barbieri.
At the Criminal Trial, it became apparent that no cellphone calls were made to Paula around this time.
The Civil Plaintiff introduced a phone bill for Simpson's home, thus established Simpson was NOT in the Bronco around 7:00 PM; instead, they established he was retrieving his voicemail messages.
It was at this moment that Kato was returning to Rockingham. Kato did NOT see the Bronco on Ashford when he parked his car.
Kato enters Kitchen, interrupting Simpson in the process of retrieving Paula's Message.

The Civil Trial revelation establishes why Clark chose to release the Police Statement to the media, rather tha introduce it to the jury. Had she introduced it, it would have immediately been discredited by the phone bill. The media performed its role predictably -- they promoted the idea Simpson was out wandering aimlessly, when in fact he was home.

The Plaintiff uses Paula's message to assert a justification for "rage". However, events earlier in the day establish the message would more likely generate feelings of relief. Simpson is relieved of the responsibility for terminating the Barbieri relationship. We know from Kato's testimony that, at 2:30 (1430), Simpson had already begun the process of finding her replacement.
Phone records -- surpressed as part of Marcia Clark's strategy -- show he was home before 7:00 PM.

1855Kato returns home just as Simpson is in the kitchen collecting his voice-mail. Simpson hears Paula's message, but dismisses it as her normal complaigning about his love of golf. He'll call her later to straighten things out; in the meantime,
Surpressed by the Criminal Prosecutors, the Civil Trial reveals Simpson used his house phone to check his messages. Surpression of the exact times was a repeated prosecution strategy; in this case, to do so required exclusion of the Police Statement. With the statement excluded the prosecution, the defense had no basis to bring in the time, as established by the telephone records.

This is important because it establishes he was home, NOT out looking for Paula -- as he believed when he gave his statement on the 13th.

Kato arrives just as Simpson is receiving the message from Paula -- Kato's arrival distracts Simpson from comprehending the content of her message. Simpson assumes she's once again upset about his having left her bed to play golf.

1932Simpson makes phone call to a girl named Gretchen Stockdale after he brings Bronco inside gate, then begins to pack before calling Sydney, possibly ?returns? call to Michelle.

2045OJ interrupts Kaelin conversation... rebukes Kato for leaving the Jacuzzi on -- and informs him it is now turned off. Kato is embarrassed, and feels he has somehow abused a privilege.
2047Simpson suggests Kato have Susan over for cookout, then goes to calls Christian Reichardt -- Faye Resnick's boyfriend. Reichardt is watching a war movie on cable -- call finished before McDonalds.
2050Simpson places Local Call to Sydney
Simpson calls Nicole's and speaks to daughter Sydney -- it's a local {same area code} call and has no phone record timestamp. They discuss the recital and hangup without him again speaking to Nicole.
2100 [9:00 PM]
2100Simpson calls Christian Reichardt.
Faye Resnick calls Nicole Brown Simpson. Converstaion, from pay phone at Rehab Center, lasts 30 minutes.

Faye Resnick's testimony creates another time when accuracy of time becomes important. Was Nicole on the phone from 9:00 to 9:30 PM? The time of the call will help establish the time that Simpson spoke to Sydney. This conversation now takes on significance -- the accuracy of Resnick's testimony will be balanced by that of Sydney Simpson. Resnick's testimony, repeated at the Civil Trial, would almost mandate that Sydney will be called to testify as to the events at Bundy -- up till the time she went to bed.
Judith Brown calls Mezzaluna, speaks to Karen Lee Crawford, who then places her on hold, goes outside & locates dropped glasses on the black top, few inches from the gutter -- cleans off mud, places glasses in envelop mark with name & words "Nicole Simpson, Prescription Glasses" & seals envelope.
ROSA MARIA LOPEZ is waiting outside the Salinger house for her friend, Sylvia, an undocumented worker who is later redacted from record
police had interbiewed her, but failed to turn over report to defense.
2103Kaelin calls another friend, Tom O'Brien.
2104While on phone with Reichardt, Simpson askes someone for the ball scores. Reichardt assumes he is speaking to Kaelin.
Who? Simpson called with someone there?

Petrocelli: Did you ever say, OJ., when you called me at 9:00 o'clock, who was that person that you asked about for the scores?" Did you ever ask him that question?
Reichardt: No, because later I found out that I heard that Kato went with him to get something to eat, so I assumed it was Kato.
2108Simpson call to Christian Reichardt ends.
2110Kaelin call ends when OJ comes in to borrow $5 for Skycap.

2113LOPEZ sees Simpson & Kaelin leave for McDonald's. While they are out, she is visited by "Sylvia" an undocumented worker -- after Sylvia leaves, Lopez hears prowler.
The prosecution pressures various defense witnesses and engages in coercion which -- while "technically" justifiable during the criminal trial -- would have been an issue had an appeal of a guilty verdict been required. One of the effects was to force Sylvia to avoid providing corrobrative testimony for Rosa.
2115from "KILLING TIME" (page 131) A girfriend of Syndey Simpson's had intended to spend the night, but because of a change in plans for the next day was picked up by her parents.
2118Kaelin checks clock at 26th and San Vicente -- comments OJ needs nap.
2120"KILLING TIME" authors use this as the time for Resnick's call to Nicole. No basis is given.
2122At McDonalds, Kaelin pays -- they're at drive-up window. Simpson eats his food during the drive home.
