2130 Judy Telander returns home.
2130 Denise Pilnak finishes dinner with her friends.
2130 Resnick-Brown phone call ends. The next day {per "KILLING TIME"} Sydney Simpson says she heard, "Mommy crying and fighting with her best friend."
Was this Faye Resnick,
who wrote in her book that the conversation was upbeat?
That they were giggling about their futures?
Or was it someone yet to be identified?
2130 Lopez hears someone outside her window towards Simpson property. Shortly thereafter, she hers Simpson & Kaelin return -- and their voices.
2133 Pilnak, a very time aware person, arrives home. At Rockingham, Kaelin & Simpson return from McDonald's.

Ron Goldman initials his time card -- punched out. He's driving a small compact car possibly red. He has a Pellegrino {mineral water}, spends next 15-20 minutes sitting & talking with DE BELLO he also talks with a couple of the waiters & bartender, Stewart Tanner.
Nicole calls Mezzaluna, speaks to Crawford who gives phone to Ron Goldman.

2135 OJ & Kato return to Rockingham.

Charles Cale finishes packing and decides to take a short walk with his dog.

2137 [PHONE BILL] Kaelin again calls Tom O'Brien.

[PHONE BILL] Juditha Brown speaks to Karen Crawford at. Mezzaluna, who then finds glasses intact outside the resturant.

2138 Charles Cale, walking his dog toward corner of Rockingham, sees neither Bronco nor Bentley.

When leaving the estate with Simpson at 9:12 PM, Kaelin checked for cars approaching from the passenger side of the Bentley -- in the direction of Ashford -- though Kealin did see an approaching car, he DID NOT see the Bronco parked on Rockingham.
Therefore, contrary to Simpson's June 13th statement to the Vannatter, the Bronco must parked on Ashford. The alternative is to hold that, though Simpson was at Rockingham, the Bronco was NOT.

QUESTION: Where was the Bronco?
The one fact which has remained constant throughout the various testimonies -- no witnesses have been introduced to corroborate the existance of the Bronco, at Rockingham between 3:00 PM and 11:15 PM on Saturday, 12 June 1994.

The intelligent juror requires corraboration of possession as an element of both Opportunity and Means.
The elements of Means and Opportunity for the Bundy Murders:
1. Aris Lites -- Did he have access to the gloves found covered in blood; did they fit?
2. Bruno Magli Lorenzo -- Did he have access to the shoes which left the bloody shoeprints; would they have fit?
3. Transportation -- Did he have access to the Bronco?
4. Knife -- Did he have access to the murder weapon?
5. Time -- did he have the time required; was there opportunity?
For the honest "jurist", it is only after these five elements are determined, that one would address possible motive.

2200The movie he was watching over, Christian Reichardt goes to bed.

Reichardt summation of situation = "misconstrued"
Petrocelli: Tell us why you're so sure, 99 percent sure, that O.J. Simpson is innocent and did not kill Ron Goldman and Nicole Brown.
Reichardt: There's a whole bunch of reasons: Number one, I know his physical condition, you know. If you would put O.J. on a chair and ask him to jump down, he wouldn't be able to do it, you know. Like I said, I've seen so much
Petrocelli: Anyway, you were telling me about O.J. Simpson's physical condition as the first reason why you believe he's 99 percent innocent. By the way, there is a 1 percent doubt in your mind. Correct?
Reichardt: I think there's a I percent doubt in anybody's mind.
Petrocelli: About OJ. Simpson?
Reichardt: About anything.
Petrocelli: So nothing can be a hundred percent.
Reichardt: Exactly.
Petrocelli: But you're about as sure you're as sure that O.J. Simpson is innocent as you are sure of any other fact.

QUESTION: Can we locate the Bronco?

PETROCELLI: You had said yesterday that you took a walk from Rockingham through the Ashford gate with the dog. Were there any other cars parked on Rockingham or Ashford when you took that walk?
Simpson: Not that I noticed.

2200 [10:00-10:30] Jason clocks out at the Resturant -- his girl friend picks him up, using his car, and they travel to her apt. drops her off, and he goes to his apartment.

-- Rosa Lopez walks Salinger dog on Rockingham.

Marcus Allen leaves for Cayman Islands I think to the best of my recollection, we left around 10 o'clock or so.

{witness, not called, claims to have seen Nicole talking to man in white truck. Standing nearby is a Caucasian/asian man [12 July testimony].}

2203 Simpson calls girl friend, Paula, using cellphone. In his VIDEO, Simpson states: "A little after 10:00, I was at my Bronco..."
2205 [2205.36] Allan Park, in Limo, is called by employer, Dale St. John.
2206 [DepRE] Simpson chips a few golf balls, but stops when a ball goes too close to Bentley -- he had recently had bodywork done to remove dings from prior chipping sessions. Gathers up golf gear.

2212 [DepRE] Brings Bronco inside gate, took out a golf bag & left it by bench.
2215 On McKenna's way home from a dinner party, she was going to drop off the sign and hammer it into the ground. On her way home from the dinner party, as she was driving home, McKenna had to decide which way to turn on Bundy: go north to her own ohome, or go south to put up the sign. She remembers looking at the clock in the car as she got to the intersection of Bundy and San Vicente. It was 10:15. A five minute drive from the intersection to her house. She said "Screw it, I'll do it tomorrow."

Pablo Fenjves, dog barks {WaD, pp 36} "I like witnesses who peg their memories to TV GUIDE. They're usually reliable. At about a quarter past to half past the hour he hears a dog barking "uncontrollably." The dog continues to bark for over an hour."
LAWYER'S LIE: The reader, like a jury, seldom stops to calculate. Fenjves testified the dog was still barking thirty minutes AFTER Schwab had brought the dog home. Fenjves could NOT have been hearing the Akita. Clark used him in the case, and in her book, to willfully mislead both the jury and her readers.

2217 ??? [DepRE] Simpson parks Bronco on Rockingham. ???
2218 [time checked] Pilnak asks friend Judy to leave.

2220 [question see 2210] Ferrara receives call from Kaelin.

[estimated] Pablo Fenjves watching 10 o'clock NEWS on Channel 5, hears dog's "plaintive wail". He stops watching TV & goes down to his office.

[time checked] Harmon in car at corner of Dorothy & Bundy. Hears NO sound of barking dogs -- street quiet. She drives down Bundy, does NOT see BRONCO.

[DepR] Simpson is in bedroom, uses bathroom, than takes shower.

2221 Judy and Pilnak go outside to Bundy, they talk for 3-4 minutes Neither sees or hears anything. NO dog barking. No screams for help.
2222 Allan William Park arrives at, sees, Rockingham address -- but NO BRONCO. He parks on Ashford, pressing the intercom at the appointed time.
2225 Pilnak & Judy finish talking and Pilnak calls her mom.
[time] Allan Park arrives at Ashford Gate, gets out of car & smokes a cigarette while listening to radio. No activity at Rockingham.
2226 [estimated] Aaronson & Mandel pass 875 South Bundy -- NO NOISE.

At 10:30 P.M., June 12, 1994, almost two hours before the bodies of nicole and Ron were discovered, an anonymous female called the LAPD and inquired about a "double homicide on the Westside." ... Indeed, there was only one double homicide in that pricey section of Los Angeles on that night -- Ron Goldman and nicole Brown Simpson. So who the hell made that call at almost precisely the time when the murders are believed to have happened?
Remaining consistant to their practice during the Criminal Trial, the LADA & LAPD have failed to disclose the precise time that this call was received. The very existence of this call implies the existence of a yet to be revealed witness.
2230 [time] Mandel looks at his watch -- NO BARKING DOGS.

-- [time] Ferrara & Kaelin still on phone -- Ferrara asks time. Inside the house, Simpson is sitting on his bed waiting for the Limousine driver to ring.

-- Allan Park gets back in Limo and waits until 10:40.

-- [estimated] Heidstra, & his dogs, reach Bundy & Gorham. No Barking Dog.

-- [10:30-11:00] Jason arrives at his apartment at Sycamore. He might have called his girlfriend. He watches TV until 3:00 AM.

2232 From "KILLING TIME" {page 131} A man visiting a neighbor of Nicole's heard a woman's scream at 10:32.
Nicole Brown Simpson is attacked about NOW
2232 at end of Dick Van Dyke Show, Stephen Schwab takes his dog for a walk.
2233 Denise Pilnak, {testifies 10:33-10:35} HEARS DOG BARKING. [confirming] Heidstra, {testifies 10:30-10:35} HEARS DOG BARKING and is able to identify it as the Akita belonging to Nicole Brown Simpson. Fearful for his dogs, because of their ages [11 & 14], he avoids Bundy.

The Akita's role in all this was eerie, to say the least. You had to wonder what the poor animal had witnesses. Had he tried to defend his mistress? Probably not.
The Simpson children were apparently so fond of Brian Kaelin, they gave their dog his nickname.
The chief trainer for the LADA's K-9 unit reported that Kato had a "very nice disposition ... [but] inadequate instincts or courage to protect his territory, owner or himself."
Still, given the barking and the mistakes in the coroner's report, Marcia concludes:
That dog, it seemed, had a better handle on the time of death than the coroner did.
2235 [time] Aaronson & Mandel in Aaronson's apartment. OJ Simpson is concerned that the driver hasn't rung yet, he goes to bathroom.
2237 Stephen Schwab is at Gretna Green.

A NORMAL & NATURAL occurance, noises in the night, takes on a sinister association.
2239 [time checked] At the Ashford Gate, the Limousine bumper lightly impacts Ashford Gate.
Inside the Rockingham Estate: Kato Kaelin, is lying on his bed and still on phone with Ferrara [she varifies] hears three thumps and a picture moves. He asks Ferrara if they had an "earthquake". Both Rachel & Kato testify it is 10:40; But when talking to Detective Fuhrman, Kaelin set the time at 10:45.

Upstairs, Simpson is in the shower; he thinks he hears buzzer. Getting no response, Park drives to the Rockingham Gate.

Press Ashford Gate Button and phone will ring a fixed number of times.
Ring to push ratio is NOT one-to-one.

Pushing the gate button triggers a series of rings.

Marcia Clark never explained how the KILLER could be in two places at same time.

F. LEE BAILEY : "I am saying they did not have enough proof to show that O.J. Simpson and no one else committed this crime because I listened with fascination to the jurors talk about what was important to them. And what apparently wasn't important to them because it was never mentioned, was the fact that on the evidence of this case, O.J. Simpson never had the time to commit these murders -- leave his home, come back, get cleaned up, hide everything so that it's never been found, and get in that limousine. It simply wasn't there and to aggravate it. Mr. Petrocelli pushed the time of the killing for a while, from 10:35 to 10:45, making it now only most unlikely that O.J. did it, but impossible."
2240 [10:40 PM]
2240 - [ estimated] Heidstra, walking in alleyway East of Bundy passes directly opposite 875 South Bundy, when he hears two male voices -- one says: "Hey, Hey, Hey". The other responds, and he identifies Nicole's Iron Gate close with a single slam. He is able to properly identify his location on map.
{WaD, pp 35} "Goldman had injuries to the neck, back, head, hands, thighs. He'd apparently put up a fierce struggle."

[per "KILLING TIME"] Sydney Simpson also hears the "Hey, Hey, Hey" and while at the station tells the police. Had it been her father's voice, she should have been able to identify it.

[time] Aaronson's roommate comes home -- Mandel {her dinner date} is still there.

At Rockingham, Allan Park backs Limo around to Rockingham Gate -- NO BRONCO "I WOULD HAVE SAW IT IF IT WAS THERE."; checking the driveway, Park sees TWO DARK CARS. One is Bentley, the other, parked in Arnelle Simpson's location is apparently her car which is photographed in that location the next day. Park Three minutes later...

Marcia Clark's view {WaD, page 61}
The killer had waged a merciless assault against an unarmed, unsuspecting victim, a victim who was rapidly trapped in a cagelike corner of metal fencing and slaughtered. Whether the motive was sexual jealousy or need to eliminate a witness, this killer had made a ruthless determination: Ron Goldman would die.
Contrast this to the death of Nicole
While Goldman's wounds suggested that the killer had been in a frenzy to kill him,. Nicole's did not. The attack had been swift, smooth, and efficient. There were no hesitation marks, no half cuts or superficial throat wounds that might have shown uncertainty. Her killer did not romance the deed. Nicole had apparently been sweept up, thrown down, slashed at the throat, and dropped at the foot of the steps.
Marcia's view has Nicole as the prime target. Nicole's friend Ron Hardy had told authorities that the intercome controlling the front gate lock was broken. To allow a visitor access, Ncole had to go out and open the gate. But we don't know why the control was broken. Since it was broken, she was either outside to unlock the gate in expectation of Ron Goldman's arrival; or was responding to the buzzer in expectation of it being Ron.

We have two logical possibilities. Both indicating the lady of the house was the target. During the trial, and civil depositions, much was made of a missing key and the possibility that Simpson had taken it. This introduces another problem: Why was Nicole outside?
If Simpson has a key, and a knife, and intent to kill... he accesses the property using the key, knocks, Nicole answers, she's dead in the doorway.
Otherwise:
1. The gate lock is disabled Friday night, or Saturday; it's a weekend, the Coop maintenance staff is off, the lock won't be repaired until Monday.
2. The killer presses the buzzer, scales the gate and secretes himself on the side pathway until the blond who lives there responds. But which blond? Nicole Brown, or Faye Resnick.

2243 -- ...Park & Limo are back at Ashford Gate {at 10:40, per Grand Jury}; he is again pressing buzzer -- no response, [10:43.44] Park calls his boss's pager.
2244 Kaelin & Ferrara conclude conversation.: Marcia Clark suggests time was 10:40-10:45, conversation may have ended about 10:48 -- both prosecution & defense have Kaelin's phone records.
2245 [estimated] Heidstra sees three cars come from direction of Bundy. The Akita is still barking. One car is described as Jeep Cherokee, or Blazer. It is white, or light color, and he conceded could be a Bronco -- that style. It heads AWAY FROM Rockingham.
--- Simpson expects Limousine to arrive for a 10:45 pickup.
--- The "earthquake" time Fuhrman was given by Kaelin.
2246 [10:46.20] Park calls his mother -- needs Boss' home number.
The Bundy Murders have ended
Explaining some points -- KATO the AKITA
Several pieces of evidence -- secondary to the murders -- were never explained. These concern Kato the Akita, Nicole's dog.
1 - When found, the Akita had blood on it's belly.
2 - Nicole had numerous blood splatters on her back.
Dog owners would quickly understand the habit of a loyal pet. The habit of moving to, and laying near, an injured master. In this case, we can surmise that KATO did this with the dying Nicole. In so doing, he acquired the blood which was later observed, matted and dried, on his belly.
We know there were literally gallons of blood around Nicole. Dogs have another instinctive habit. When wet, they shake the liquid off. This would account for the blood splatters. It is an action which generates significant "disturbance" -- sufficient to scatter some fine trace elements {hair, dirt, blood); some of which would have landed in locations where forensic collections were later done.
2247 [10:45-10:50] Louis Karp arrives home. {feb 8 #6}
2248 [10:48.40] Park concludes call to mother.
2249 [10:49.07] Park calls Boss at home -- no answer.
2250 [10:50 PM]
2250 Allan Park again pressing the buzzer at Ashford Gate.

At the Civil Proceding, Brian Kaelin testified he heard the noise at around 10:50. While this contradicts his Criminal Trial Testimony -- which had been corraboraterd by Rachel Farrara, it is consistant with his "Kato says OJ did it" appearance on GERALDO.

2251 Kaelin see the Limo goes up driveway and around behind the garage onto the south walkway. {entry light off}.

[On March 23rd, Marcia Clark repeats the testimony to the Court, in this exchange:
"MS. CLARK: OKAY. FOR THE RECORD, THE WITNESS HAS INDICATED HE WALKED SOUTH ON THE DRIVEWAY OVER TO THE GARAGE AREA, MADE A LEFT AT THE CORNER OF THE GARAGE AND WALKED IN ON THAT SOUTH PATHWAY A SHORT DISTANCE.
THE COURT: YES."

Kaelin was on South walkway {where right glove was found} when Simpson claims he brought his luggage out.
Moments later, at 10:54, Allan Park Sees BOTH Simpson and Kaelin.

Marcia Clark Lies in her Summation

2252 [10:52.17] Dale St. John calls Allan Park. Park is at Ashford Gate.
2253 Heidstra listens to Akita -- sporadic barking which stops around 10:55 when Schwab leashes it.
Schwab has taken charge of AKITA, at corner of Dorothy & Bundy. Akita follows him and barks at doorway of each house.
2254 Allan Park sees Kaelin rounding house; coming back on driveway, Kaelin sees the golf bag in front of the entry of house. Kaelin crosses driveway into middle of driveway and at 10:56 activates the Ashford Gate control.

In the intrum, Allan Park sees SIMPSON going towards the entry door to house. Park estimates thses concurrant events to be 30 seconds before call ends.

2255 [10:55.42] Simpson turns on the entrance light after entering the house {per Grand Jury}. Light is OFF as Kaelin passes, but ON after Park sees both Kaelin & Simpson.
Park conculdes call to St. John. thirty seconds later, Park again buzzes. Simpson answers, says -- he overslept & just got out of shower, "be down in a minute."

Private eye Bill Pavelic, who works for Simpson, suggests that the bloody paw prints heading down Bundy Drive might indicate that Nicole Simpson's Akita was chasing after the killer. If so, that would undercut the prosecution's murder scenario, which had Simpson dashing out the back gate into his waiting Bronco.

2300 Pablo Fenjves goes back upstairs -- dog is still barking. He goes to shutters, looks toward Nicole's, sees lights on upstairs.
-- [time] Mandel leaves Aaronson's Apartment -- reports no unusal sounds.
-- Fenjves returns to bed, testifies he hears same dog barking, possibly past 11:40PM.
[time] Heidstra is in his apartment, 11 o'clock NEWS just starting. Simpson brings out designer bag and sets it down. Golf clubs already out. Simpson goes back into house for cellphone on kitchen counter.
While Kaelin & Park talk, Simpson goes to Bronco, which explains the timing and appearance of the blood drops connecting the Front Door to the Bronco.
Many players lose alot of feeling in their hands as well and that could be one reason why OJ Simpson could have cut himself and not know he was bleeding.
Coroner's report states:
The decedent 94-05136 was last known to be alive at about 2300 hrs. speaking to her mother on the telephone. 2300 hrs
, or 11:00 PM.
2300 Rosa Lopez hears Simpson et al outside.
2301 Schwab flags POLICE CAR which is coming down Bundy from Montana. Car makes U-turn, Schwab tells {young black uniformed} officer about finding the Akita -- police car follows him towards Montana.
2302 Kaelin & Park are talking about flashlight when Simpson goes to Bronco to get cellphone case. {He doesn't realize he has small cut, which has dropped blood in the entryway, and now leaves a trail of drops to the Bronco depositing some blood beneath the door handle.} which is Simpson goes into house 2nd time (per Allan Park) -- with Kaelin following, they seek a better flashlight. Within seconds of entering the Kitchen, Simpson notices the time and realizes he has to leave.

THE WITNESS: It was this feeling that it was not genuine. To me, my feeling was that. And I couldn't figure out why he wanted to check, because the flight and that. So it was kind of, huh. So it just left me--just gave me a strange feeling.

2303 Allan Park sees small bag behind Bentley; Kaelin also sees the bag, or knapsack; Simpson says he'll get it, passes Kaelin and brings it into Limousine. Kaelin presses button to open Rockingham Gate; waits until gate closes before returning inside -- Limousine departs.
2305 Schwab & Akita are back at his house just after start of "Mary Tyler Moore Show".

Exiting Rockingham, Park sees vehicle to his left; to his right THERE WERE NO CARS -- where the Bronco is found the next day. THE BRONCO ISN'T THERE.

[verified] Ferrara receives call from Kaelin -- they talk about "earthquake". Park testifies that they left between 11:05 & 11:15.
[phone bill] Kaelin is back on phone to Ferrara.

2310 [11:10 PM]
2318 Pilnak estimates that all dogs finally stopped barking.
2320 [11:20 PM]
2325 [phone bill] Kaelin again calls Ferrara [3rd time].
2328 "MTM Show" ending as Schwab gives Akita some water. Message on machine says Animal Control {on Bundy and Missouri} can't come for Akita & would be closed at midnight.
2330 [11:30 PM]
2330 Steward Tanner arrives home from work.
2335 Limousine arrives at LAX and Simpson asked for autograph -- he obliges.

At Bundy, [11:30-11:40] Pablo Fenjves continues to hear the same dog wailing.

2338 [verified] Last time Park see OJ Simpson.
2339 [pay phone] Kaelin/Ferrara call is interupted [call waiting] by Simpson. He forgot to set the house Alarm -- he tells Kaelin the code.
2340 [11:40 PM]
2340 Schwab neighbors, Sukru & Bettina, come home. Sukru offers to take care of the dog overnight. Schwab gives him the dog & goes to bed.
Clark tells us of Suku's arrival {page 67} ... home to his apartment on Montana Avenue---only about six hundred feet from the crime scene---around 11:40 PM. He found his upstairs neighbor sitting with a big white Akita.
Six hundred feet -- about two city blocks from the crime scene.
2341 Kaelin ends call to Ferrara and RUNS to set alarm --
"I didn't want to go back outside. I was scared.
2345 Simpson's American Airlines flight to Chicago departs 11:45 PM PCT, arrives 5:30 AM CST.
